Hi i live in Queensland Australia, i have been breeding bristlenose catfish for a while and selling them to the local pet shops in the area, some shops though say i shouldn't be doing it under law, i havn't been able to find anything that says i shouldn't be doing it, is there any laws for this or are they just using that as an excuse to send me off..

Hi,

I dont think there is a law that says that hobbists cant sell to shops. The shop that I worked at gladly took breeders fish as long as they were at the right price.

We used to get the seller to sign a form to say they were the breeders for the reasons to make sure the register tallied and also for tax reasons.

So I dont know why they are saying that its illegal for you to sell your fish to shops.

Ps I also am in Queensland.

There are very strict laws re non professional Fishermen selling their catch.

Technically as you are a seller their could easy be some local trading laws. Eg If you are transporting something for sale you should have a correctly registered car. Also possibly a hawkers licence.

There *was* something on this, but it was years ago when I heard about it, and there wa a way around it so that shops still got the fish and breeders still offloaded.

Could well have been the tax thing as most do it cash in hand, but I think it was more than that...


Suggest that you get store credit instead of cash?

Sell privately (ship via AAE or Fastway)?

thanks for the replys, i useually buy things from the stores anyway for my fish or next batchs of fry.

just looked up the act, it doesn't apply in qld.

according to fair trading you no longer have to have a licence.

Businesses and consumers have benefited from several changes to fair trading legislation passed by Parliament last month.

Key changes which took place as of Wednesday 24 April include:

Hawkers

* Hawkers are no longer required to be licensed by law.
* Hawkers who have renewed their licence within the last 12 months will receive a pro-rata refund of their registration fees.

ive sold many fish to many fish stores and none of them have said anything about this law to me.

yeh, i dont think there is anything stopping us, i think it's just some of the bigger stores and chain stores that dont wanna risk anything, not that there is anything to really risk, if there's a drama i refund or replace.. thanks guys.

Fishkid,

I would suggest not commenting on a foriegn countries laws if you dont have expierence in them. They are very different from the US (they have a parliment ). If you do have expierence then I am an idiot and please lend your expertise
