c'mon... granted it's not fun getting hit by a car, but that's why we have insurance for the love of pete.


but unless you sue you wont get anything from their insurance if you are a pedestrian! Maybe in the States, I dont know if the pedestrian's medical insurance would claim from the car insurance, but in the UK at least, it would all be on the NHS and no money would be recouped by anyone at any point.

In the US, stuff like this is covered by insurance. Pretty much all medical bills are covered by something. I don't know about Australia, but yes in Britain they're not, thanks to the NHS. If you want to see a private practitioner, you have to pay or have health insurance that most of the time is really more of a luxury. Soooo there is a cultural difference there that may be causing a little misunderstanding here...

Actually, I don't. But I recognise that there are circumstances when recourse to law is appropriate. And in my own personal circumstances, it was. Furthermore, until the extra information that appeared following my post was posted, I considered my post to be useful advice. In my own circumstances (which I posted above), I was struck at speed by a motorist who entered a roundabout, in clear violation of the Highway Code, which states that vehicles on a roundabout have right of way. As I said to my lawyer afterwards, it went "earth, sky, earth, sky, earth, sky, ouch". A bit more substantial than a hangnail.

And as a tangential aside, I do not know many people who would consider a university educated mathematician with an IQ in the top four percent (courtesy of the Wechsler parametric test) and an understanding of general relativity, quantum mechanics and tensor analysis to be a 'peabrain'.

Feel better...I don't think I'll be walking across anything anytime soon...you are the third person I know to be hit by a car this week All in all you are the best of the bunch

The first was killed instantly. The other was lifeflighted to one Herman Memorial Hospital; where they take the worst cases, and had immediate surgery, where they couldn't stop the internal bleeding...but she is now in ICU and doing better...

Consider yourself really lucky that you are able to be home so fast with so little damage...feel better... and take care...oh one more thing never play chicken with a car again...heidi

I've come close to being hit in my town...clearly marked pedestrian crossings ...signs in the road marking the crossing...signs on the side of the road marking the crossing...police that do give tickets for stop sign runnings....and the whole side of town where I live was laid out with pedestrians in mind (built as part of the new deal back during the american great depression)...and still I have to glare @people when they dont stop

in the US is it standard practise for an insurer to pay a sum to an accident victim? Above and beyond their medical expenses (which are already covered in the UK anyway) without legal action of any kind?

Its not required, but yes, most insurance companies will offer a settlement to the injured instead of having to deal with going through a lawsuit.

Basically, they bribe the accident victim into not prosecuting a lawsuit. The victim has to choose whether the settlement is enough for them to not bother with the hassle or risk of filing a lawsuit. Most of the time, if a suit is filed because the amount offerred by the insurance company was not satisfactory, then the victim will win more money than the insurance company offerred, but they are then responsible for lawyer fees and court costs, so they sometimes end up with less money than the original settlement that was offerred. There's also the possibility that the judge or jury (depending on which decides the case) decides that it is a frivolous lawsuit and awards no compensation and the person is still out their court costs and (in some cases) lawyer fees...

The problem I had was that the careless motorist who T-boned me made a statement claiming that I had hit her ... and her insurance company stonewalled. So I had to take legal action to put down what was obviously a complete fabrication of events by the defendant. Still, the insurers eventually saw sense and settled out of court, when they realised that [1] I wasn't going to budge from the facts; [2] I had submitted repeated reports containing said facts; [3] those reports also contained point by point rebuttals of the defendant's case (including a little question along the lines of how she would explain there being no damage to the front of my bicycle if I had hit her - obviously I spun around 180&#176; immediately before the collision, ha, ha, which again was unlikely on an August day with brilliant sunshine, perfectly dry and grippy road conditions and temperatures already above 80&#176;F at 10am) and [4] if the insurers had persisted on stonewalling, then they stood a chance not only of having to foot a big bill for my compensation, but paying ALL my legal costs as well as their own, plus 10% interest above base rate over the period during which they had stonewalled (i.e., 2 years) to both myself and my lawyers. A nice little indemnity feature of UK law that makes it expensive to go to court and lose.

In cases where such shenanigans do not take place, the lawyers tend not to become involved. But when you have a careless motorist who then tries to fabricate a defence that can be demolished without having to break sweat, and an insurance company that sticks to said fabricated defence, then the lawyers do tend to become involved.
